Livermore Defense: "No Constitutional Right to a Safe Internet."

The City of Livermore, CA, has responded forcefully to a lawsuit that alleges that the city library violates constitutional rights because it bills itself as a place for children but does not tell parents that children can be severely injured by exposure to obscenity and pornography on the Internet. "The Due Process Clause does not protect Plaintiff and her son against the dangers inherent in living in a free society. There is no constitutional right to a safe Internet," states a brief filed January 4 by Assistant City Attorney Dan Sodergren. A hearing in the case is scheduled for January 13.
